This Kabuto will lose 10 HP if it evolves into Fossil Kabutops. I imagine this was an oversight, because they appeared to be taking some care to make sure no Basic Pokémon card had HP higher than a Dark Pokémon they could evolve into during Generation 2 and 3 of the TCG – but Kabuto isn’t a Basic Pokémon, and Kabutops wasn’t a Dark Pokémon, so you can see how if this was an unwritten rule they were trying to adhere to, how it would’ve slipped through.
It wasn’t until Generation 4 that they began to regularly break this ‘rule’, and at this point there are several examples of Pokémon that can lose 20 HP if they evolve into a Stage 1 card from an older set. (There might be some that lose 30 HP or more, but I can’t readily come up with an example.)
